IMPORTANT: AI Service and Agreement by Use

Jask Reporter is an artificial intelligence (AI) system, not a human agent. This is a B2B service where your company has already provided consent and information. For subscribed companies, we process conversations using the information already provided by your organization. If you contact us without an active subscription, we will collect your phone number, inform you that you are interacting with AI, and encourage you to sign up for our services. By using our services, you agree to these Terms of Service and our Privacy Policy.

2. Service Description

Jask Reporter is an AI-powered reporting service that processes your WhatsApp conversations and generates automated reports through:

  • WhatsApp Messaging: AI-powered conversation processing and analysis through WhatsApp
  • Conversation Transcription: Automatic transcription of WhatsApp conversations for analysis
  • Automated PDF Reporting: AI-generated PDF reports based on your conversation content and data, automatically created and delivered
  • Email Delivery: Automatic delivery of generated reports to your specified email address

3. Automatic Registration and Consent

Automatic Registration Process:

1. For subscribed companies, we process conversations using the information already provided by your organization

2. If you contact us without an active subscription, we will collect your phone number and inform you about our AI service

3. By using our services, you consent to:

  • Registration in our user database
  • These Terms of Service
  • Our Privacy Policy
  • Contact via WhatsApp, phone, and email
  • Voice recording and conversation analysis

4. User Eligibility and Account

4.1 Age Requirements

You must be at least 16 years old to use our services. Our services are not available to minors under 16 years of age. By using our services, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into binding agreements.

4.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4.3 Account Security

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

5. Service Usage Rules

5.1 Acceptable Use

  • Use services only for lawful purposes
  • Provide accurate information in your WhatsApp conversations
  • Use the service only for legitimate business reporting needs
  • Report any issues or concerns promptly

5.2 Prohibited Activities

  • Harassing, threatening, or abusing our staff or systems
  • Providing false or misleading information
  • Using services for illegal activities
  • Attempting to circumvent security measures
  • Reverse engineering or copying our AI technology
  • Spamming or sending unsolicited communications

6. AI Services and Data Processing

AI Interaction Disclosure:

You are interacting directly with an artificial intelligence system, not a human representative. We disclose this AI interaction and data processing practices to new users at the beginning of their first WhatsApp conversation. Our AI services use advanced technology including natural language processing and automated decision-making to process your WhatsApp conversations and generate reports. All conversations are processed for analysis and transcription. WhatsApp integration is handled through our secure communication platform.

6.1 WhatsApp Conversations and Data Processing

  • All WhatsApp conversations are processed and analyzed for report generation purposes
  • Conversation data is processed and handled for transcription and analysis
  • All text conversations are processed for content analysis and report generation
  • WhatsApp integration is managed through our secure communication platform
  • Your phone number is automatically collected when you message us via WhatsApp
  • New users are informed about AI interaction and data processing during their first conversation
  • Conversation data and transcripts are stored securely and may be analyzed to improve AI responses
  • You consent to data processing, transcription, and phone number collection by continuing the conversation

6.2 AI Limitations and Disclosure Policy

  • AI responses are automated and may contain errors
  • We do not guarantee the accuracy of AI-generated answers and reports
  • Human review may be required for complex requests
  • AI disclosure is provided to new users only; returning users are not repeatedly notified
  • Consent for AI interaction and recording remains valid for returning users

7. Service Fees and Billing

B2B Service Model

Jask Reporter operates as a B2B service with tiered subscription plans: Free (no charge, limited features), Plus (per-seat pricing at €25/user/month), and Pro Unlimited (€299/month billed annually or €349/month billed monthly). Pricing may vary; current prices are always available on our pricing page.

7.1 Subscription Fees

Service fees are based on your subscription plan. The Free tier has no charge. The Plus plan is billed per seat at €25/user/month. The Pro Unlimited plan is billed at €299/month (annual) or €349/month (monthly). Pricing may vary and current prices are available on our pricing page.

Fee Changes: Any changes to our fee structure will be communicated to your company with adequate notice period.

Service Access: Only companies with active subscriptions can access our reporting services.

8.2 Billing and Payments

Payments are processed according to your company's subscription agreement. All billing is handled through our secure payment system.

8.3 Payment Processing

Payment processing is handled through secure third-party payment providers with appropriate business protections.

7.4 Refund and No-Refund Policy

IMPORTANT: Jask Reporter offers free trial periods for paid subscription plans — 14 days for the Plus plan and 30 days for the Pro Unlimited plan — allowing you to fully evaluate the service before any payment is charged. The Free tier does not include a trial period as it is free of charge. Once the applicable free trial period ends and your paid subscription begins, all fees paid are final and non-refundable. This includes, but is not limited to:

  • Monthly or annual subscription fees, regardless of usage or remaining subscription period
  • Any credited balance added to your account, whether purchased directly or received as part of a promotion
  • Fees for add-on services or features
  • Any amounts already billed or charged to your payment method

This no-refund policy is justified because: (a) a free trial period (14 days for Plus, 30 days for Pro Unlimited) is provided to evaluate the service before any payment obligation arises; (b) our service constitutes digital content and services that begin performance immediately upon subscription activation with your express consent; and (c) by subscribing after the free trial, you acknowledge that you have had sufficient opportunity to evaluate the service.

7.4.1 Non-Refundable Credited Balance

Any credited balance on your account, whether obtained through direct purchase, promotional offers, or any other means, is non-refundable and non-transferable. Credited balance can only be used for services within the Jask Reporter platform and has no cash value. Upon account cancellation or termination, any remaining credited balance will be forfeited.

7.4.2 Subscription Cancellation

You may cancel your subscription at any time. Upon cancellation, your service will continue until the end of the current billing period. No refunds or credits will be issued for partial billing periods, unused time, or remaining credited balance. Cancellation does not entitle you to a refund of any amounts already paid.

7.4.3 Exceptions

Refunds may only be considered in exceptional cases where required by mandatory applicable law that cannot be waived by agreement, or where a material service failure attributable solely to HeyJustAsk S.L.U. prevents the service from being provided entirely. Any such refund is at the sole discretion of HeyJustAsk S.L.U. and subject to verification.

8. Consumer Rights (Spanish Law)

Your Consumer Rights:

As a consumer in Spain, you have specific rights under Spanish consumer protection law (TRLGDCU - Real Decreto Legislativo 1/2007) and EU consumer directives.

8.1 Right to Information

8.2 Right of Withdrawal and Digital Content Exception

Under Spanish law (Article 103.m TRLGDCU), the 14-day right of withdrawal does not apply to the supply of digital content or digital services when performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.

By subscribing to Jask Reporter after your free trial period and expressly consenting to the immediate commencement of the digital service, you acknowledge and agree that:

  • You expressly request that the service begins immediately upon subscription activation
  • You acknowledge that you lose your right of withdrawal once the digital service has commenced
  • The free trial period (14 days for Plus, 30 days for Pro Unlimited) has provided you with sufficient opportunity to evaluate the service before any payment obligation
  • No refund will be due for any amounts paid after the free trial period

This consent is obtained during the subscription process, and by completing your subscription you confirm your understanding and acceptance of these terms.

8.3 Complaint Resolution

You have the right to file complaints with consumer protection authorities and access alternative dispute resolution mechanisms. Nothing in our no-refund policy limits your statutory rights where mandatory consumer protection laws apply.

9. Liability and Disclaimers

9.1 Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable for maintenance or technical issues.

9.2 Third-Party Services

We are not liable for the actions, services, or performance of third-party technology providers used in our service delivery.

Third-Party Terms and Responsibility:

Important: By using our service, you automatically agree to the terms of service and privacy policies of our third-party technology providers:

  • N8N: WhatsApp integration and automation services
  • WhatsApp: Messaging platform and communication services
  • Supabase: Database hosting, storage management, and file storage services for images and reports. By using our service, you agree to Supabase's Terms of Service (supabase.com/terms) and Privacy Policy (supabase.com/privacy). Storage capacity depends on your subscription plan, and you are responsible for managing your storage usage.
  • Google Cloud: Cloud infrastructure and processing services

We are not responsible for how these third-party services handle your data, their service availability, security breaches, or compliance with their own terms. Any disputes with these providers must be resolved directly with them according to their respective terms and policies.

10.3 Limitation of Liability

To the maximum extent permitted by Spanish law, our liability is limited to the amount paid for our services in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

10.4 Consumer Protection Override

Nothing in these terms limits your statutory rights as a consumer under Spanish or EU law. Where our terms conflict with mandatory consumer protection laws, those laws prevail.

10. Intellectual Property and User Content

10.1 Our Rights

The Jask Reporter platform, AI technology, trademarks, and content are owned by HeyJustAsk S.L.U. and protected by intellectual property laws.

10.2 User Content Responsibility

By using our services, you grant us a license to use your conversation content for service provision, improvement, and AI training purposes.

11. Account Termination and Banning Policy

11.1 Your Right to Terminate

To Delete Your Account:

Send an email to contact@heyjask.com requesting account deletion. We will process your request within 30 days and delete all personal data as required by GDPR.

We may terminate or ban accounts, subscriptions, or users immediately and without prior notice for:

12.1 Internal Resolution

For complaints or disputes, first contact us at contact@heyjask.com. We will respond within 15 days and attempt to resolve the issue within 30 days.

12.2 Consumer Arbitration

Consumers may access the Spanish Consumer Arbitration System (Sistema Arbitral de Consumo) for dispute resolution.

12.3 ODR Platform

EU consumers can use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr for online purchase disputes.

12.4 Governing Law and Jurisdiction

These terms are governed by Spanish law. Spanish courts have jurisdiction, but consumers may also bring proceedings in their country of residence.

13. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, network failures, or other force majeure events.

14. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated by:

  • Email notification to registered users
  • Notice on our website
  • Notification during your next service interaction

Updated terms apply to all subscriptions, including existing ones, as of the effective date. If you do not agree with material changes, you may cancel your subscription. Continued use after changes constitutes acceptance of new terms.

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
